Illegal aliens should realize that America does have laws. They should further realize that they cannot put their kids in front of them as a shield to remain in this country. Americans are desperate to hang onto what little life we have left - we have been destroyed by illegal aliens... If you respect our laws, there should be no problem. If you do, however, count on putting your kids in front of you for protection as a free path to this country, it's a risk you must take. I have no sympathy for this woman. She was stealing from our country.

Leave the adopted son here and send the illegal back to where she came from.

I wouldn't want to take a child from it's mother but the mother took that risk when she came here illegally. Now her child is a US citizen but she isn't and as far as I'm concerned she doesn't have any of the rights a US citizen does. Is this fair to the child? I don't know but I do know that she should have thought of that before she came into our country illegally and had a child here. She put the child in this mess and she should not be allowed to use that child as an excuse to stay here. The choices imo for her would be either give up the child and be deported or take the child and be deported. End of story.
Did you folks read the story, or just the headline? She wants her child back, but through improper legal procedures she was deprived of her child without due process of law. From what I gather, the Supreme Court was unanimous in that conclusion. The case is now remanded to determine whether she "abandoned" her child and that the proper steps are taken to end her right to parentage.
EVERYBODY in this country, legal, illegal, immigrant, natural born, tourist even, are entitled to the same due process of law as every other person. Her status as an illegal alien is irrelevant to the issue of whether she is a fit parent.
Nor can I figure out what it is that this woman "stole" from this country. Her crime was identity theft--which means that she used a fake ID when she got a job at the poultry packing plant. Which meand she was working for a living at a job Americans won't take, just like all the migrant farm workers do.
Yes she has rights, but most illegals use their children as a tool to stay in this country along with getting money from welfare. She knew what she was doing when she came here using another person social security number and stealing from a citizens by doing this she should of went to jail for many more years and deported as soon as she was release from jail.
As for the child our laws needs to be change if your parent are not citizens of this country or illegal than when a child is born they do not get citizenship here period. Now this child have been living with their new parent for a while which could hurt this child if that relationship is taken away, this is a hard call but I would say maybe it is best to give the child back to the mother deporting both. No matter which way this go someone is going to get hurt, our government has cause this problem by not enforcing our laws do to businesses wanting cheap labor.
If our laws was enforce we wouldn't be having the problems nor would children be in the middle, I for one do not feel illegals care about any of their children for all they are is a tool to help them make money, stay in this country for to many people feel sorry for people breaking our laws and not really care about this country or it citizens.
Our country is coming apart due to so many people coming here not accepting our way of life but trying to change our country to the way their country was. How many countries can we have here, since every time people come they make a small section of our country to be like their country.

There is no evidence in the article that she used her child as a tool to stay here, no evidence that she was on welfare (rather that she was working) and no evidence that she was "stealing" from a citizen. Yes she used someone elses SSN--and because she was employed, made monetary contributions to that person's social security account, contributions she can never recover. Why should she stay in jail for many more years than what the law prescribes?
Who says that the south american immigrants are "not accepting our way of life"? Their US born children are usually highly americanized, just like the children of any other immigrant group. The US has always been a melting pot of many cultures--except for the native americans, we are all immigrants, and I suspect that the majority came here without passports. Immigration laws are enacted not because we are antiimmigrant, but to control the numbers of peoples coming here, no more no less. And the fact is that this country needs south american immigrants to do millions of jobs in agriculture, janitorial services, meat cutting, etc etc that don't pay enough or are "too hard" for American workers--even if they are on welfare--to consider taking.
